REWI: Ihr beruflicher Weg verlief…
Gregor Christandl: …sicherlich anders als geplant. Als ich mein Jus-Studium aufgenommen habe, wollte ich unbedingt Richter werden. Im Gymnasium hatten wir jährlich eine amerikanische Reisegruppe zu Gast, für die wir ein kleines Theaterstück aufführten, in dem ich die Rolle des Richters spielte. Etwas daran hat mich fasziniert und in mir den Wunsch reifen lassen, Richter zu werden. Mein ausgeprägtes Bedürfnis, für Recht und Gerechtigkeit einzutreten, bildete dafür die Grundlage. Als ich aber mein Jusstudium abgeschlossen hatte, war gerade eine Assistentenstelle am Institut für Italienisches Recht der Universität Innsbruck freigeworden, auf die ich mich bewarb. Rasch wurde mir klar, dass die universitäre Arbeit in Forschung und Lehre meine eigentliche Berufung ist. So promovierte ich bei Bernhard Eccher in Innsbruck mit einer rechtsvergleichenden Arbeit zum immateriellen Schadenersatz. Danach musste ich hinaus in die Welt: Ich absolvierte 2009/2010 einen Masterstudiengang an der Yale Law School, USA und trat daraufhin eine Habilitationsstelle bei Reinhard Zimmermann am Max Planck Institut für Ausländisches und Internationales Privatrecht in Hamburg an. Mit einer erbrechtlichen Habilitationsschrift wurde ich 2015 an der Universität Innsbruck für die Fächer Bürgerliches Recht, Rechtsvergleichung und Internationales Privatrecht habilitiert. Seither war ich assoziierter Professor und Institutsleiter an der Universität Innsbruck und freue mich nun ganz auf meine neue Tätigkeit als Professor für Bürgerliches Recht an der Universität Graz.
REWI: Darum Wissenschaft und Lehre…
Gregor Christandl: …weil wir als Juristen dazu aufgerufen sind, auf unsere eigene Weise und nach unseren Möglichkeiten einen Beitrag zur Weiterentwicklung und Verbesserung des Rechts zu leisten. Für mich habe ich erkannt, dass ich diesen Beitrag am besten durch Wissenschaft und Lehre erbringen kann. Die Wissenschaft gibt mir die Freiheit, mich mit dem zu beschäftigen, was mich wirklich interessiert und die Lehre gibt mir die Möglichkeit das dadurch erworbene Wissen zu teilen und von den Beiträgen und Fragen der Studierenden zu lernen.
REWI: Nicht nur Erben will gelernt sein...
Gregor Christandl: … auch Vererben ist nicht leicht. Eigentlich ist dies ja der viel schwierigere Teil, denn er setzt einmal voraus, dass man sich der eigenen Sterblichkeit auseinandersetzt. Viele Menschen überwinden sich dazu erst, nachdem sie das 60. Lebensjahr überschritten haben und überlegen erst dann, wie sie ihren Nachlass aufteilen möchten. Nicht selten ist aber auch zu spät, denn mit zunehmendem Alter wird man häufig vergesslicher und anfälliger für altersbedingte Krankheiten. Demenz kann zu Testierunfähigkeit führen. Pflegebedürftigkeit führt zu Abhängigkeitsverhältnissen und setzt die Testierfreiheit einer erhöhten Gefahr für Fremdbestimmung aus. Mit dem Schutz der Testierfreiheit in einer alternden Gesellschaft habe ich mich in meiner Habilitationsschrift detailliert auseinandergesetzt und aufgezeigt, wie schwierig es ist, gerade bei verletzlichen Personen in Abhängigkeitsverhältnissen eine selbstbestimmte Entscheidung sicherzustellen. Wer heute 30 oder 40 Jahre alt ist und über ein gewisses Vermögen verfügt, sollte nicht davor zurückschrecken, sich über die Verteilung seines Vermögens im Falle seines plötzlichen Todes Gedanken zu machen. Wenn das gesetzliche Erbrecht nicht passt, sollte bereits in jungen Jahren ein Testament errichtet und dieses dann im Laufe des Lebens regelmäßig an die aktuelle Lebenssituation angepasst werden. Nicht in allen Fällen sind die Wünsche des Einzelnen aber leicht umsetzbar, sodass eine Beratung durch einen Notar oder Rechtsanwalt ratsam ist. Gerade bei komplexeren Vermögensverhältnissen oder aufgrund der Umstände des Einzelfalls könnte sich selbst ein Testament als ungeeignet erweisen, um die gewünschten Ziele zu erreichen, sodass sich Formen der antizipierten Erbfolge oder sogenannte will substitutes, d.h. alternative Verfügungsformen, anbieten.
REWI: Das Spannendste am italienischen Recht, das Spannendste am österreichischen…
Gregor Christandl: Ich fand es immer spannend, das österreichische und das italienische Recht miteinander zu vergleichen. Das italienische Privatrecht gehört der romanischen Rechtsfamilie an und bezieht somit sein kulturelles Erbe aus dem französischen Code civil. Das österreichische Recht gehört dagegen dem germanischen Rechtskreis an, wählt aber in vielen Fragen den goldenen Mittelweg zwischen dem deutschen und dem italienischen Recht. Neben dem offenen, in vielen Teilen wenig dogmatischen und in erster Linie prinzipienorientierten Stil hat auch dies zum Erfolg des ABGB beigetragen, das heute mit dem französischen Code civil zu den ältesten geltenden Zivilgesetzbüchern der Welt zählt.

Gregor Christandl: Da fällt mir jetzt nichts ein, aber hin und wieder etwas mehr Entspanntheit würde mir sicherlich nicht schaden.
REWI: Das überrascht selbst Leute, die Sie kennen…
Gregor Christandl: Ich bin in Südtirol mitten in den Bergen aufgewachsen und da überrascht es doch recht häufig, dass ich nicht schon von Kindesbeinen an auf Skiern gestanden bin und nicht täglich auf den Berg steige, was Tirolern ja häufig selbstredend unterstellt wird. Im landschaftlich sanfteren und unglaublich reizvollen Umland von Graz werde ich mich daher sehr gut zurechtfinden.

Gregor Christandl: Musik ist für mich sehr stimmungsabhängig. Wenn ich nicht gerade selbst Klavier spiele, höre ich sehr gerne Klassik und Jazz, aber auch Popmusik erzeugt bei mir nicht selten einen Ohrwurm…

Gregor Christandl: Ich habe den Eindruck gewonnen, dass ich für meine Projekte in Graz auf ein sehr offenes Umfeld treffe, in dem ein großes Interesse an internationalem Austausch und rechtsvergleichender Arbeit besteht. Ich freue mich auf die Zusammenarbeit mit meinen Kolleginnen und Kollegen am Institut für Zivilrecht und freue mich ganz besonders auf die Studierenden, die ich in meinem Fach begleiten darf.
